Aircast App Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Aircast mobile application, website, and related services (collectively, the “Services”) provided by Convergence Event Systems Pty Ltd ACN 607 263 721 trading as Aircast (“Aircast”,“we”, “our”, or “us”).
By downloading, accessing, or using the Aircast App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
1. Eligibility
You must be at least 13 years of age, or the minimum legal age required in your jurisdiction, to use the Services.
If you are using the Services on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
2. Licence Grant
Subject to your compliance with these Terms, Aircast grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the Aircast App on devices that you own or control.
This licence is solely for your personal or authorised business use in connection with the Services.
3. Apple App Store Terms
If you download the App from Apple’s App Store:
These Terms are between you and Aircast, not Apple.
Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support services for the App.
To the maximum extent permitted by law, Apple shall have no warranty obligations regarding the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You must comply with all applicable App Store terms and policies.
4. User Accounts
Certain features may require registration of an account.
You agree to:
Provide accurate and current information;
Keep your login credentials secure;
Be responsible for all activity conducted through your account; and
Notify Aircast immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to:
Use the Services unlawfully or fraudulently;
Interfere with or disrupt the operation of the Services;
Attempt to gain unauthorised access to systems or networks;
Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the App except where permitted by law;
Upload or distribute malicious software, viruses, or harmful code;
Circumvent security or access controls;
Reproduce, distribute, or commercially exploit any content without authorisation; or
Use the Services in a manner that infringes intellectual property rights or privacy rights.
6. Streaming Content and Broadcast Services
Aircast may provide access to live streams, video, audio, data feeds, statistics, highlights, and other media content.
Such content may be:
Subject to territorial restrictions;
Delayed, interrupted, or unavailable from time to time;
Protected by copyright and other intellectual property laws; and
Available only under licences granted by rights holders.
You may not record, redistribute, retransmit, modify, or commercially exploit any content unless expressly authorised by Aircast.
Availability of any event, stream, or content is not guaranteed.
7. User Content
Where the Services permit you to upload, submit, post, or transmit content (“User Content”), you retain ownership of your User Content.
By submitting User Content, you grant Aircast a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, and use that content for the purpose of operating, improving, and promoting the Services.
You warrant that:
You own or control all necessary rights in the User Content; and
Your User Content does not violate any law or third-party rights.
8. Intellectual Property
The Aircast App, Services, software, trademarks, branding, graphics, content, and technology are owned by or licensed to Aircast.
Except as expressly permitted in these Terms, no rights are granted to you.
All rights not expressly granted are reserved.
9. Privacy
Your privacy is important to us.
Our collection, use, storage, and disclosure of personal information is governed by our Privacy Policy, available at:

By using the Services, you consent to the collection and processing of your information in accordance with the Privacy Policy.
10. Third-Party Services
The Services may contain links to third-party websites, products, or services.
Aircast does not control and is not responsible for third-party content, products, services, policies, or practices.
Your use of third-party services is at your own risk and subject to their terms.
11. Subscription Services and Purchases
Certain features may be offered through subscriptions or in-app purchases.
Where applicable:
Pricing will be displayed before purchase;
Payments may be processed through Apple or other authorised providers;
Subscription renewals may occur automatically unless cancelled;
Refunds are governed by the policies of the relevant payment provider or app marketplace.
Aircast reserves the right to change pricing and subscription offerings at any time.
12. Service Availability
We aim to provide reliable Services but do not guarantee uninterrupted availability.
We may:
Modify features;
Suspend functionality;
Perform maintenance;
Restrict access; or
Discontinue portions of the Services
without prior notice where reasonably necessary.
13. Disclaimer
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis.
Aircast does not warrant that:
The Services will be uninterrupted, secure, or error-free;
Content will be accurate, complete, or current;
Defects will be corrected; or
The Services will meet your specific requirements.
14. Limitation of Liability
To the fullest extent permitted by law, Aircast shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including:
Loss of profits;
Loss of revenue;
Loss of business opportunities;
Loss of goodwill;
Loss of data; or
Service interruptions.
Where liability cannot be excluded, Aircast’s total liability shall be limited to the amount paid by you to Aircast for the Services during the twelve (12) months preceding the claim.
Nothing in these Terms excludes rights that cannot be excluded under applicable law.
15. Indemnity
You agree to indemnify and hold harmless Aircast, its directors, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, and expenses arising from:
Your use of the Services;
Your breach of these Terms; or
Your violation of any law or third-party rights.
16. Suspension and Termination
We may suspend or terminate your access immediately if:
You breach these Terms;
We are required by law to do so; or
Continued access creates security, legal, or operational risks.
Upon termination, your right to use the Services immediately ceases.
17. Changes to These Terms
Aircast may update these Terms from time to time.
Updated Terms will be posted on our website and within the App where appropriate.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.
The parties submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

20. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented within the Services, constitute the entire agreement between you and Aircast regarding the Services and supersede all prior agreements relating to their subject matter.
